Las Vegas Uncontested Divorce Lawyer

Divorce Attorneys with the Power to Keep the Peace

Just the mention of the word, “divorce,” can evoke images of a husband and wife arguing with each other because they cannot reach an agreement on how to divide their property and marital assets.

While such disagreements can happen in divorces, this is not the case for all couples. Some husbands and wives are willing to put aside their differences long enough to settle all of their issues even before going to court. For any couple facing this distinction, The Hill Law Group and MyVegasFamilyLaw.com is here to provide legal assistance to make the process of Uncontested Divorce go smooth while keeping your best interest as the number one priority.

Uncontested Divorce in Nevada

An uncontested divorce can be filed when the parties have agreed on every issue in their case. Before filing a joint petition for an uncontested divorce, a husband and wife must agree on ALL issues including:

  • The amount of alimony or spousal support to be paid, if the spouses have not waived their rights to such payments.
  • Dividing the marital debts and assets, including bank accounts, vehicles, retirement and pension plans, 401 (k)‘s, IRA’s, houses and other real estate property.
  • Child support and custody. Parents must decide the legal custody of the children, which means that each parent has the right to make decisions about their children’s health, education, religion and welfare. Parents must also decide with whom the child will live and the amount of time with each parent, and visitation rights for the non-custodial parent. Child Support is set by statute as a percentage of the gross monthly income and how many children there are. Child support is also based upon the amount of time the children are with each parent.

Uncontested divorces in Las Vegas are not as costly as contested divorces because they are usually granted within one to two months, so the divorcing couple and their attorney do not have to spend much time in court, if at all.

Filing for Divorce

Once all issues are resolved, a joint petition for divorce can be filed in court. The document must outline how the couple will handle each matter. If a judge is satisfied with the information presented, the divorce will be granted. If the court discovers that a couple could not agree on an issue, the case then becomes a contested divorce and will take more time to resolve.

An Attorney’s Role in an Uncontested Divorce

Because the husband and wife have to agree on everything in an uncontested divorce, they may think that hiring a Divorce Attorney is unnecessary.

In uncontested divorce cases, it is advantageous for an objective Divorce Attorney to be in the picture. An experienced Uncontested Divorce Lawyer can review the agreement and prepare the paperwork to make sure it is done right the first time. The attorney can also file the joint petition in court.
